By accessing the Hexa Developers website, creating an account, or placing an order for web and software development services, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree with any part of these terms, you must discontinue your use of our website and services immediately.
These Terms constitute a legally binding agreement between you ("Client", "User", or "You") and Hexa Developers ("Company", "We", "Us", or "Our"). We reserve the right to update or modify these Terms at any time without prior notice. Continued use of our platform after modifications indicates acceptance of the updated terms.
2. Services Description
Hexa Developers provides an e-commerce platform designed to streamline web design, frontend and backend development, mobile application creation, UI/UX design, and cloud infrastructure deployment. Our services are sold as standardized packages as well as custom enterprise solutions.
- Fixed-scope development packages ordered directly through our online catalog.
- Custom software development and architecture tailored to specific client specifications.
- Ongoing maintenance, optimization, and technical support services.
Each service order is defined by the scope, deliverables, and timeline specified during the checkout process or within an agreed Statement of Work (SOW).
3. User Accounts
To place orders and access your project dashboard, you must register for an account on the Hexa Developers platform. You agree to provide accurate, current, and complete information during registration and keep your account details updated.
- You are responsible for maintaining the confidentiality of your account credentials.
- You accept responsibility for all activities, orders, and communications under your account.
- You must notify Hexa Developers immediately of any suspected unauthorized access or breach of security.
4. Orders & Payments
Hexa Developers offers transparent pricing structured into clear service tiers:
- Starter ($699): Designed for landing pages, portfolio sites, and core responsive web experiences. Includes essential UI design, mobile responsiveness, and standard contact forms.
- Professional ($1299): Designed for growing businesses requiring custom web applications, CMS integration, dynamic databases, e-commerce features, and API integrations.
- Enterprise (Contact Sales): Tailored software architectures, dedicated engineering teams, high-availability cloud infrastructure, custom security protocols, and SLA guarantees.
Payments are processed securely via authorized third-party gateways. Full payment or the specified initial deposit is required prior to commencing project development. Additional features or scope modifications requested after project kickoff will be invoiced separately upon written approval.
5. Intellectual Property
Upon full settlement of all project invoices and fees, Hexa Developers transfers exclusive ownership rights of final custom deliverables—including bespoke source code, visual assets, and design files—to the Client.
- Pre-Existing Code: Hexa Developers retains ownership of proprietary libraries, pre-existing frameworks, developer tooling, and open-source components used to construct deliverables. Client receives a perpetual, non-exclusive, royalty-free license to use these components within the delivered product.
- Client Materials: The Client retains all rights to branding, logos, trademarks, and content supplied to Hexa Developers for project execution.
- Portfolio Rights: Hexa Developers reserves the right to display completed projects in online portfolios, case studies, and promotional materials unless covered by a signed Non-Disclosure Agreement (NDA).
6. Project Delivery & Revisions
Estimated completion timelines begin once all required client materials (branding assets, copy, credentials) are received and project kickoff is confirmed.
- Starter Package: Includes up to two (2) rounds of design and layout revisions during staging.
- Professional Package: Includes up to four (4) rounds of design, functional, and structural revisions.
- Enterprise Package: Revisions are governed by the dedicated Statement of Work and agile sprint agreements.
Client delays in providing feedback or required assets exceeding 10 business days may result in timeline adjustments and project rescheduling. Final delivery is completed upon deployment to the production environment or handover of source files.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Hexa Developers, its directors, employees, or partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, profits, data, or business opportunities arising from your use of our platform or services.
In no event shall Hexa Developers' total aggregate liability for any claim exceed the total amount actually paid by you to Hexa Developers for the specific project giving rise to the claim during the twelve (12) months preceding the event.
8. Termination
Either party may terminate a project agreement or service subscription under the following conditions:
- By Client: You may request project cancellation prior to development kickoff for a full refund less administrative fees. Post-kickoff cancellations are pro-rated based on work completed.
- By Hexa Developers: We reserve the right to suspend or terminate services immediately if you breach these Terms, fail to make required payments, or engage in unlawful or abusive conduct.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Hexa Developers operates, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in courts of competent jurisdiction.
